Terms of Service
Please read the following terms carefully before using our services.
1. Our Sales Process
For your security, payments are processed securely through PayPal, a global payment platform with Level 1 PCI-DSS certification. We accept all major credit/debit cards (Visa, Mastercard, American Express) and PayPal account balances. We do not store credit card data on our servers; all financial data is managed entirely by PayPal.
By making a payment, you also agree to PayPal's User Agreement and their Privacy Policy.
2. Pre-Validation and Regeneration Guarantee
To ensure your satisfaction, you can review and approve the character likeness and story text before making payment.
Once payment is made, the system grants you one (1) additional opportunity to regenerate the content if you wish.
By confirming the "I love it, send it to me" button, you give your final approval and the product is considered delivered and accepted.
3. Digital Product Delivery
Delivery formats by product:
- • Quick Stories ($15): Digital PDF + printable PDF, immediate email delivery.
- • Personalized Story ($24): Personalized digital PDF with unique illustrations, immediate delivery.
- • Interactive eBook ($6): Flipbook viewer with narration and music, permanent access.
After successful payment, you will receive an immediate download link on screen and a copy to your email.
Technical guarantee: If an error occurs during generation after payment, our system will automatically send a recovery link to your email so you can access your story at no additional cost.
4. Consent, Use of Photographs and Privacy
By uploading photographs, you confirm that: (a) you are the parent or legal guardian of the minor in the photo, or have authorization to upload it; (b) you authorize Magic Memories Books to process said images using Artificial Intelligence exclusively to create the illustrations for your personalized book; (c) you understand that photos will NOT be used for AI training, marketing, or any other purpose.
Automatic Data Deletion:
- • Original photographs: Automatically deleted within a maximum of 72 hours after upload, allowing issue resolution.
- • Personalization data: Deleted along with photographs within the same 72-hour timeframe.
Digital Files: Generated PDFs contain only artistic illustrations (not original photographs) and are kept for your permanent access.

5. Intellectual Property
You retain ownership of the generated stories for personal use. Magic Memories Books will not use images of minors or your personalized characters for promotional purposes without prior, explicit, and written consent.
6. No Refund Policy
Since our process allows you to review and approve both the text and illustrations of your story before making payment, and you have a regeneration opportunity after payment, no refunds are offered under any circumstances.
By confirming the approval button, you accept the final product as previously reviewed. If after regeneration the result is not to your liking, you may create a new story with different personalization options.
Sole exception: In the event of a technical failure, our team will send a recovery link via email. If the failure persists and it is impossible to deliver the digital product after exhausting all recovery options, a full refund will be issued.
7. Use of AI Technology
This service uses advanced AI models (such as GPT-4 and FLUX). You accept that the artistic style and narrative are AI interpretations based on your personalization instructions.
Illustration variations: AI-generated images may present slight variations between illustrations of characters, such as in hair shape or clothing. This is inherent to AI image generation technology.
AI Hallucinations: You accept that AI may generate unexpected narrative or visual elements (known as "hallucinations"). The text and cover are reviewed and approved before payment. Interior illustrations are generated after payment, and you have two (2) regeneration opportunities per illustration to correct or discard unwanted elements before final approval.
8. Eligibility and Use
To use our services, you must be at least 18 years old or have the consent of a parent or legal guardian. By using this service, you represent that you have the legal authority to accept these terms.
You agree not to use the service to create inappropriate, offensive, illegal content, or content that violates third-party rights.
9. Limitation of Liability
Magic Memories Books provides its services "as is." We do not guarantee that the service will be uninterrupted, error-free, or completely secure. To the maximum extent permitted by law, our total liability for any claim shall not exceed the amount paid for the product in question.
10. Governing Law and Jurisdiction
These terms shall be governed by and construed in accordance with the laws of Spain. Any dispute arising from these terms shall be subject to the jurisdiction of the competent courts of Málaga, Spain. For European Union users, this does not affect your consumer rights under the applicable legislation of your country of residence.
11. Modifications
We reserve the right to modify these terms at any time. Changes will be posted on this page with the update date. Continued use of the service after publication of changes constitutes your acceptance of the modified terms.
